1,500 Americans filed for bankruptcy each day last year. They should have done this instead.

Julian Torres at MarketWatch reported that about 1,500 Americans filed for personal bankruptcy every day last year, up 47% from 2022, with filings still rising more than 12% in early 2026 as borrowing costs and living expenses climbed. He asked what people should do before they get there.

My position is that bankruptcy has to be your final option. Run down all your other avenues first. It stays on a credit report for 7 to 10 years, it can cost you assets, and some debts, like most student loans, do not go away in the process anyway. The longer you wait to address the problem, the narrower that window gets and the fewer options you have.

The first step is diagnosing which problem you actually have. A cash-flow problem means the money to pay the loans shows up some months and not others. The remedies there are lifestyle adjustments, a real budget and negotiating with creditors, who would rather get paid slowly than not at all. A debt-load problem means the total is unmanageable at any realistic income. That is when options like settling the debt and, lastly, bankruptcy get examined.

Most people I see wait until the cash-flow problem has quietly become a debt-load problem. The same conversation a year earlier has more exits.
